I just had my neighbour across the street come over and tell me my baby-monitor is interfering with HIS 鈥榓irspace鈥?as he does something with radio(s)

鈥?. tells me I am using an illegal channel!

Demanded to see the monitor and said he is reporting me to some communications govt dept.

Is this true? 鈥?Can he do this? ......It鈥檚 only a baby monitor!!

and .. NO I won't be turning it off.

I used to have a Ham radio licence and unfortunately for you he could be in the right. In spite of the advice in one answer Australia is only strict on these things by the regulation, not by the enforcement. In reality Australian standards against interference etc are quite poor. There is some inspection of consumer items but a lot of crap gets through.

Knowing the source of a lot of this sort of stuff I would not put it past the manufacturers to get something approved on one frequency and then switch the guts of the thing to another because it is cheaper or to remove filters that prevent interference. Did anyone mention China? Not me.

If the frequency is an exclusive one you can be required to cease and desist even though you bought the thing in good faith. That is a stone fact. Radio amateurs have had the army removed from their exclusive allocations in the past. If the frequency is a shared one then he will have to put up with it. If the device does not meet regulations you may be required to turn it off or have it modified so that it does. It does not matter whether it is a baby monitor, a faulty television, a dodgy fridge motor or even a bad fluorescent tube.

I would not make a war of it. He could legally monitor the transmission - there is nothing you can do about that, anyone can, quite legally. There is no regulation on receivers on any frequency, as long as they do not interfere with signals on any frequency. You transmit, anyone may receive.

There is no such thing as an illegal scanner. You or I can listen to police, fire, army, navy, air force, ambulance, aircraft, taxi and all the rest all day if we want to, if we had the receivers and there is nothing that anyone can do about it. They transmit, anyone may receive.

He can also transmit on the same frequency with maybe up to 100 Watts and amplified by a high gain antenna, right at your house, which is going to make your monitor useless. If he is within the band plan, there is nothing you can do about that either. If he has a licence to transmit, then he may transmit.

The police in the states have next to no power over radio matters, it is entirely a federal matter.

Not exactly. Your waves may be crossing over but that's not something you can control so there's no illegality to it. If he was going to report someone it would be the maker of the monitor, not you.

I agree with Silly Boy. Also, I'm not sure how it is in Australia but in the U.S. it is EXTREMELY difficult to get a secure frequency. It almost takes an act of Congress.

This man sounds like he is trying to intimidate you. It sounds like you're the one who could lodge a complaint with the police.

If it was sold to you legally by a reputable store, chances are you are not doing anything illegal. The manufacturers are only allowed to use certain frequencies (just like remote control cars etc).
I would be careful however - I am sure he can tune into your baby monitor anytime he wants now that he knows its transmitting frequency, and eavesdrop on what is going on in your house! When my brother and sister-in-law had their first baby, the next door neighbours came over once, quite embarrassed, to tell them that they had the same baby monitor and could hear everything going on in their bedroom (where the crib was)! They went to the store that day and returned their monitor (same model), for one with a different frequency marked on the box.
