as long as he still has legal ID, and he's not driving, there shouldn't be a probelm.
Since it's a Criminal Code offence ("felony" in American terms), he could be denied entry.

No, he shouldn't try it at this time: things are getting really difficult at both US and Canadian Borders...they are double checking everyone.
