It is certainly true that Taiwan is not a part of China. China ceded Taiwan to Japan in 1895. In the post-WWII period, there are no international treaties or other legal documents which can show that the territorial sovereignty of Taiwan has ever been ceded to China (either PRC or ROC).

Hence, while we must recognize that Taiwan is not a part of the PRC, nevertheless it is also true that Taiwan is not a part of the ROC.

Indeed, new territory has to be incorporated into the ROC via the procedures of Article 4 of the ROC Constitution, and in the case of Taiwan (which under international law was Japanese territory up until April 28, 1952), those procedures have never been completed.

As a result, since the ROC government is not holding the "territorial title" to Taiwan, so of course the "ROC in Taiwan" cannot be considered an independent sovereign nation.

The leaders of international organizations (such as the United Nations) are well aware of these facts, however the people in Taiwan have been brainwashed for over sixty years that they are the "real China." In fact, nothing could be further from the truth.

At the present time, Taiwan remains as occupied territory. The post-war San Francisco Peace Treaty of 1952 specifies that the principal occupying power is the United States of America.

The ROC in Taiwan is thus (1) a subordinate occupying power, beginning Oct. 25, 1945, and (2) a government in exile, beginning mid-December 1949.
